Pre-sale purchase agreement (real estate)

Property Description: A detailed description of the property or asset that is the subject of the transaction.

Price and terms of payment: specification of the sale price and any conditions related to the method of payment (such as advances, installments, etc.).

Conditions precedent: any conditions that must be met for the transaction to become binding, such as obtaining certain approvals or meeting specific conditions.

Deadline for concluding the final contract: setting a deadline by which the parties undertake to conclude the final contract of sale.
Commitment of the parties: a statement of serious intention to complete the transaction, indicating that the parties agree to continue negotiations and reach a final agreement.

Validity period: establishing a period of time for which the pre-contract is valid and binding on the parties.

The pre-contract is binding, but does not transfer ownership of the asset. To transfer ownership, use a sale-purchase contract.

You can be represented for the conclusion of the pre-contract using a power of attorney.

The pre-contract can be concluded at a notary public or under private signature (only with the signature of the parties).

If one of the parties refuses to sign the final contract, the judge can order that consent be supplemented by a court order that will replace the sales contract. We can give you details during a consultation.
